Privacy Statement

The website www.shop.wackerneuson.com and the online shop integrated in the website (hereinafter collectively "E-Store") are operated by Wacker Neuson SE, Preußenstraße 41, 80809 Munich, Germany (hereinafter "WN" or "we"). WN attaches great importance to the protection of your personal data and collects, processes and uses your personal data exclusively in accordance with the principles described below and in compliance with applicable data privacy laws. As an operator offering goods or services to members of the EU, the GDPR applies for all processing activities related to E-Store.

A.    Your personal data

Personal data are all data relating to an identified or identifiable natural person. This includes, for example, your name, your telephone number and your postal and e-mail addresses. We collect those data exclusively directly from you as the data subject.

B.    Processing of personal data 

WN processes your personal data exclusively within the scope described below.

I.    Wacker Neuson Customer Account 

A personal customer account (hereinafter "Customer Account") needs to be set up in order to use our E-Store. Storing your relevant information in your Customer Account makes shopping in the E-Store faster and more convenient.

To set up your personal Customer Account, we need your personal contact information (salutation, first and last name, language and telephone number, additional voluntary information: title, function and mobile telephone number) and information on your company (name of company, field of activity, business address, additional voluntary information: VAT ID number, your Wacker Neuson customer number). We also require your e-mail address, which also serves as your user name for the Customer Account, and a password freely selected by you. You can change your password at any time for the future. We and/or Wacker Neuson Ltd., WN Place,
Beacon Way, Stafford, ST18 0DG, United Kingdom (hereinafter "WN UK" ) can also update your information if you wish. The legal basis for the processing is Art. 6 (1) lit. b GDPR. Your account will remain in effect until you request its deletion .

II.     Orders in the E-Store

Your orders in our online shop are normally processed by WN UK, which, as your contractual partner, is responsible for the fulfilment of the purchase contracts. Some products, in particular those, which are to be manufactured individually in accordance with your wishes, are sold directly by our dealers. In order to process your orders, we forward the details of your orders (type and price of purchased product, date and time of order etc.) to WN UK or to the dealer responsible for your supply territory. To do so, we grant WN UK access to the data stored in your Customer Account (cf. B.I).
Alternatively, during the order process you can specify a delivery address, which is different to the invoice address stored in your Customer Account. If you wish, we store any different delivery address in your Customer Account so that you do not have to enter this again for your next purchase.
After completing your order, you receive an order confirmation by e-mail in which you will be requested to evidence your commercial activity when placing your first order. For this, we request you to provide us electronically via our E-Store or by fax with a copy of your trade licence, your chamber of commerce or professional association identification card or a similar appropriate document. If you upload this document electronically, it will be stored in your Customer Account. The legal basis for the processing is Art. 6 (1) lit. b GDPR.

III.    Review of order volume

To process orders securely, we allocate an individual order volume to each of our customers, which may generally not be exceeded for the orders placed via our E-Store. For determining your order volume, we take into consideration, amongst other things, the form of your company and the value and number of purchases made by you in the past. During the order process, we will review whether the total value of the goods selected by you is covered by your order volume and, if payment is made by credit card, whether this is covered by your credit card limit. If this is not the case, we will inform you of this before completion of the order and request you to contact us directly. The legal basis for the processing is Art. 6 (1) lit. b GDPR.

IV.    Contact form 

You can contact WN UK directly using the contact form provided in the E-Store. WN UK collects, processes and uses the information provided by you via the contact form (salutation, first and last name, e-mail address, postal address, company name, subject and content of your message) exclusively to process your request. The data is being erased  afterwards. The submission of your request via this contact form is considered your consent into processing (Art. 6 (1) lit. a GDPR).

V.    Wacker Neuson newsletter

You can also subscribe to our electronic newsletter in our E-Store by clicking on the checkbox "Keep me informed about the latest offers and news". Alternatively, you can also subscribe to our newsletter in the personal section of your Customer Account under "My Account" in the section "Profile".
If you have provided your consent to this, we and/or WN UK use the e-mail address provided by you to send you current product information and information about Wacker Neuson. By segmenting our customers, we aim to send you such information, which we estimate to be of particular interest to you. The legal basis for the processing is your consent (Art. 6 (1) lit a GDPR).

Following successful subscription to the newsletter, you will automatically receive an e-mail requesting you to confirm your e-mail address. Once you have confirmed your e-mail address by clicking on the link contained in the confirmation e-mail, you will regularly receive our newsletter.
You can unsubscribe from the newsletter and revoke your consent at any time by sending an e-mail to info.estore@wackerneuson.com (see also Section D in this respect).

VI.     Advertising by post

As a customer of our E-Store, you will from time to time receive product information from us and/or WN UK by post. If you do not wish to receive such information by post, you can object to the processing and use of your personal data for advertising purposes at any time for the future by contacting us under the address specified in Section E.

We also communicate your name and postal address for advertising purposes to our dealer who is responsible for your supply territory. An overview of the dealers responsible for the relevant supply territory can be accessed via the following link: https://locations.wackerneuson.com/lf/ . The dealer may, if applicable, inform you via post about its own products and services (in particular maintenance). The legal basis for the processing is Art. 6 (1) lit. f, Recital 47 GDPR (direct marketing purposes).

VII.    Use of logistics providers and other service providers

To ship your order, WN UK as the party responsible for the fulfilment of the individual purchase contracts will provide your personal data to external logistics providers who will process these data on behalf of WN UK and in compliance with the required security measures exclusively for the purpose of fulfilling the contract (Art. 6 (1) lit. b GDPR).

We also use specialised service providers (to perform certain services in particular for payment processing) who will process your personal data on behalf of WN UK and exclusively in accordance with its instructions (processing on behalf, Art. 28 GDPR).

VIII.     Cookies

WN uses cookies in the E-Store. Cookies are small text files that are saved locally in the cache of your browser to facilitate recognition of your browser and to make your visit to our E-Store even more attractive for you.
In this context, we use session cookies or persistent cookies. Session cookies are automatically deleted when you leave the E-Store. Persistent cookies remain on your end device for a longer period and allow us to save, for example, the content of your shopping basket or the country settings as well as to use the tools described below for web analysis.

Of course, you can also visit our E-Store without cookies being saved in your browser. You can restrict or deactivate the storage of cookies at any time in your browser settings. This may, however, lead to restrictions of the functions and the ease of use of our E-Store. The legal basis for the processing is Art. 6 (1) lit. f GDPR. The use of this type of cookies is necessary in order to offer you the correct products and to simplify basic functions of the service.

IX.     Web analysis tools – Google Analytics

Given your consent, this E-Store uses Google Analytics, a web analysis service of Google Inc. ("Google"), USA. Google Analytics uses cookies allowing an analysis of your use of the E-Store. Information generated by the cookie concerning your use of this E-Store is transferred to and stored on a server of Google. IP anonymization has been activated in this E-Store, which means that Google shortens the user IP address in the Member States of the European Union or other Contracting States to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and be shortened there. On our behalf, Google will use this information to analyse the use of the E-Store by its users, put together reports on E-Store activities and provide further services to the E-Store operator pertaining to the use of the E-Store and the Internet. The IP address provided by your browser through Google Analytics will not be combined with other data of Google. You can additionally prevent the storage of cookies by adjusting the settings of your browser software accordingly; please note, however, that in such case you might not be able to fully use all functions of the E-Store. In addition, users can prevent collection of the data generated by the cookie and pertaining to their use of the E-Store (including your IP address) by Google and the processing of such data by Google by downloading and installing the following browser plug-in available under the following link. The legal basis for the processing is your consent following Art. 6 (1) lit. a GDPR.

C.    Data security 

WN uses technical and organisational security measures to protect the data provided to us from random or deliberate manipulation, loss, destruction or access by unauthorised persons. Our security measures are improved continuously in accordance with technological developments. Please note, however, that when communicating via the Internet, above all when data is transferred by e-mail, absolute data security cannot be guaranteed and that we recommend sending confidential information by post.

D.    Revocation of consent 

You can revoke your consent at any time with effect for the future free of charge by sending an e-mail to info.estore@wackerneuson.com, by written notice to Wacker Neuson Ltd., Beacon Business Park, Weston Road, Stafford, ST18 0WL, United Kingdom or by contacting our data protection contacts (see Section E in this respect). 

E.    Your rights as a data subject

You have the right of access (Article 15), rectification (Article 16), erasure (Article 17), restriction on processing (Article 18), objection to processing (Article 21) and data portability (Article 20 GDPR).

In case of a breach of data protection, the person affected may file a complaint with the competent regulatory authorities. The competent data protection authority is the data protection officer of the German state in which our company is headquartered.
